Hon’ble Manoj Kumar Tiwari, J. (1) Mr. Garuav Singh, learned counsel for the petitioners. (2) Mr. G.C. Joshi, learned A.G.A. for the State of Uttarakhand. (3) Petitioners have approached this Court for protection. According to them, they got married on 30.12.2024, as per Muslim customs. They submit that due to their marriage against the wish of parents and family members of petitioner no. 1, they are facing threat to their life. (4) Both petitioners are personally present before the Court who are duly identified by their learned counsel Mr. Gaurav Singh. We have also interacted with them. (5) According to petitioner no. 2, he is employed as Driver with M/s Haridwar Builders at Haridwar. He further stated that he had studied upto 8th Standard. Petitioner No. 1 stated that she has studied upto 12th Standard and her date of birth is 01.01.2005. Certificate of Registration of Marriage issued by Marriage Registration Officer, Ghaziabad is on record as annexure no. 2 to the writ petition, which is dated 02.01.2025. (6) Since both the petitioners are major and they are living together with their own free will, hence in view of the law laid down by Hon’ble Apex Court in the 2025:UHC:289-DB case of Lata Singh Vs. State of U.P. and Another; 2006 (5) SCC 475, we are inclined to grant protection to the petitioners. (7) Accordingly, the present writ petition is disposed of with direction to the Station House Officer, P.S. Manglour, District Haridwar to provide protection to the petitioners for a period of six weeks and ensure that no harm is caused to them during this period. Upon expiry of six weeks, concerned SHO shall make assessment of threat perception to the petitioners, and provide protection to them, if needed, for such further period, as is felt necessary.
