JUSTICE SUDESH BANSAL Order 11/03/2025 1. Petitioner has filed instant writ petition, feeling aggrieved by the order dated 14.11.2008 passed by the District Judge, Kota in Execution Case No.1/1997, declining to detach the properties of petitioner. The Execution Case No.1/1997 was initiated by the respondent-State Bank of India to execute the money decree dated 07.11.1987. [2025:RJ-JP:11212] (2 of 2) [CW-2750/2010] 2. This Court vide order dated 24.02.2025 call for the status report of the execution. As per status report dated 03.03.2025 received from the District Judge, Kota, the Execution itself has been dismissed in default and for want of non-prosecution way back on 27.10.2010. 3. Since the execution itself has been dismissed, the interlocutory order dated 14.11.2008 passed in the execution has also merged in the order of dismissal and the properties of petitioner may not be treated to be attached. 4.
