Issue a writ order or direction in the nature of mandamus commanding/directing the respondent no.2 i.e. Sub Divisional Magistrate, Tehsil- Rudrapur, District Deoria to decide the Case No. 6/2011-2012, Computer Case No. T20110520388 (Baliram Vs. State of U.P.) under section 33/39 of Uttar Pradesh Land Revenue Act, 1901, pending since 2003, within stipulated period or time fixed by this Hon'ble Court." 3. From perusal of the writ petition and annexures annexed thereto, it appears that the aforementioned case is pending before respondent no.2 for adjudication. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the respondent No. 2, Sub Divisional Magistrate, Tehsil-Rudrapur, District Deoria to consider and decide the aforementioned case in accordance with law, expeditiously, preferably within a period of four months from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned and after giving a reasonable opportunity of leading evidence in respect of their case provided that there is no other legal impediment.
