Order 25/03/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.486/2022 registered at Police Station Patan (Sikar), District Sikar for the offence(s) under Sections 384 and 506 of IPC and Section 3/25 of Arms Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the FIR was registered in the year 2022 and the recovery of fire arm was made in 2024. It is also contended that the allegation of opening fire is perse false. No cartridges were recovered from the place of occurrence. The other co- accused Pradeep Kumar has already been enlarged on bail. The accused-petitioner is in custody since 03.12.2024, trial of the case
[2025:RJ-JP:13309] (2 of 3) [CRLMB-3630/2025] may take considerable time and charge-sheet has already been produced, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the accused-petitioner is a habitual offender and against him, 10 cases have been registered under various offences and at the instance of the petitioner only fire arm was recovered, therefore, considering the criminal antecedents of the petitioner, the bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case. Considering the fact that the petitioner has remained in custody since 03.12.2024 and trial of the case may take considerable time, therefore, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rohitash S/o Indraj, in connection with FIR No.486/2022 registered at Police Station Patan (Sikar), District Sikar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.

In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Magistrate.
