2025:JHHC:11496 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.2372 of 2025 ----- Dipak Rawani, S/o Mathur Rawani, R/o village-Dhokhara Bauri Toli, P.O. Damodarpur, P.S.-Baliapur, District-Dhanbad … Petitioner. Versus The State of Jharkhand … Opp. Party. CORAM : SRI ANANDA SEN, J. ------ For the Petitioner : Mr. Mukesh Bihari Lal, Advocate : Mr. Rajiv Kumar Karan, Advocate For the State : Ms. Snehlika Bhagat, A.P.P. …...... 02 /16.04.2025: Heard the parties. 2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Saraidhela P.S. Case No. 290 of 2024, for offences registered under Sections 309(4) & 309(6) of the Bharatiya Nyaya Sanhita, 2023. The case is pending presently in the court of learned Chief Judicial Magistrate, Dhanbad. 3. Though, the petitioner is not named in the FIR, but I find that this is a case under Sections 309(4) & 309(6) of the Bharatiya Nyaya Sanhita, 2023 where the informant was robbed. This is not a case of grant of anticipatory bail as because during the investigation, it is necessary to interrogate the petitioner and also to put him on T.I. Parade. The petitioner relies upon the anticipatory bail granted to some of the co-accused on several conditions including condition of depositing cash sureties. Be that as it may since this is a case where it is necessary to put the petitioner on T.I.P during investigation, I am not inclined to grant anticipatory bail to the petitioner. 2025:JHHC:11496 2 4. Considering the nature of allegation, I feel that this is not a case for grant of anticipatory bail, accordingly, this anticipatory bail application stands dismissed. (ANANDA SEN, J.) Arpit/
