SREENIVASA REDDY Criminal Petition No.2803 of 2025 Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused, seeking antiCiPatOry bail, in connection with Crime No.123 of 2025 of Prohibition and Excise Stationv Rajamahendravaram-South, East Godavari d-lstrict. 2. A case has been registered against the Petitioner herein for the offence pun'IShable under Section 7-B read with 8-A and 8-B of the A.P. Prohibition (Amendment) Act, 2020. 3. Case of the prosecution iS that On 26.02.2025, at about ll.30 AM, on reliable infOrmat'lOn, the Sub-Inspector of Police, Prohibition and Excise Station, Rajamahendravaram-South, along with his Staff, proceeded to Relligaddi bushes adjacent tO Make up Cheruvu near varalakshmi colony in Hukumpeta Grama Panchayat of t Rajamahendravaram Rural mandal, and found 1400 litres of FJ Wash s'__ in 7 plastic drums and 70 litres of FJ wash in 2 plastic Cans, total 1470 l|ltres of FJ Wash, which was fit for distillation Of ID liquor, and also 35 litres of ID liquor in a Plastic Can. On enquiry, the persons ava-llable near the scene of Offence informed that the Pet-ltiOner herein/accused is the owner of the said FJ Wash drums. After `--' - collecting samples, the police seized the remaining ID liquor `destroyed the drums with remaining FJ Wash under cover of a spec'lal report and registered a case against the accused. 4. Heard. Perused the record. \/-I.lfl-. 5. A perusal of the material on record goes to show that no contraband is seized from the possession of the accused, and based on the particulars disclosed by the persons available near the scene of offence and mentioned in the special report, the petitioner herein has been arraigned as accused in the present crime. Learned Additional Public Prosecutor submitted that most of the investigation has been completed. 6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner herein on the following conditions, i) In the event of arrest of the petition:r herein in the aforesaid crime, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,OOO/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer. ii) Petitioner shall cooperate with the investigatio'n and he shall I make himself available for interrogation by a police-officer as and when required, and he shall not, directly or indirectly, make any Sts-i,I ri``¢ F7=---_a To, 3 I inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. iii) Petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 AM and 1.OO PM, till filing of the charge sheet. 7.
