Heard Mr. Kartikeya Shukla, learned counsel for the petitioner, Mr. Krishna Kumar Chand, learned counsel for respondents and learned Standing Counsel for the State. 2. At this stage, learned counsel for the petitioner fairly submits that the prayer Nos. 2 and 3 may be considered which are as follows : ii) Issue a writ order order or direction in the nature of mandamus commanding and directing the respondent no.2 to take appropriate action on the representation dated 24.12.2022 and initiate a fresh inquiry regarding arbitrary action of the authorities. iii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent no.3 to conduct examination (2022-2023) regarding the promotion of Class-IV employees. 2. Mr. Kartikeya Shukla, learned counsel for the petitioner submits that earlier on two occasions examination for purpose of promotion was convened, however, later on it was cancelled. 3. Learned counsel for Board submits that the matter is under consideration before the Secretary of the Borad. 4. I have considered the above submissions and perused the record. 5. The grievance of the petitioner has substance and has also taken note by the concerned respondents and presently is seized with Secretary, Uttar Pradesh Basic Shiksha Parishad. 6. In the aforesaid circumstances instead of to decide this issue on merits since matter is still seized with the Secretary of the Board, therefore this writ petition is disposed of that a reasoned decision be taken by the concerned Secretary, within a short period in accordance with the relevant provisions and if necessary stand of the petitioner may also be heard. 7. The aforesaid exercise shall be concluded within six months. 8. Accordingly, the writ petition is disposed of.
