2. Mr. Bhaskar Chandra Joshi, learned A.G.A. with Mr. Vikas Uniyal, learned Brief Holder for the State of Uttarakhand/ respondent Nos.1 and 2.
3. Learned State Counsel on instruction submits that after investigation, charge- sheet has been submitted against the petitioners on 14.01.2021, therefore, nothing remains to be decided in this writ petition and it has become infructuous.
4. This fact is not disputed by learned counsel appearing for petitioners.
5. In view of the statement made by
learned counsel for the parties, the present criminal writ petition is dismissed as infructuous. However, a liberty is given to petitioners to challenge the charge- sheet in appropriate proceedings before the appropriate forum.
6. Interim
order dated 31.12.2020 stands vacated.
