This is an application under Section 482 CrPC preferred by the applicant for quashing the impugned order dated 01.02.2023 as well as Recovery Warrant dated 04.10.2023 passed by Judicial Magistrate, Bansi/Siddharth Nagar, in Criminal Misc. Case No.1731 of 2021 (Smt. Noor Jahan Vs. Mohd Husain & others) under Section 12 of Domestic Violence Act, Police Station- Jogiya Udaypur, District- Siddharth Nagar, but the learned counsel for the applicant has confined his relief only for a direction for consideration of the bail application with expedition. 3. Learned A.G.A. has no objection to the same. 4. Considering the submissions raised at the Bar and the statements so sought to be made by them, the application stands disposed of while observing that in case appropriate proceeding in the form of bail application is preferred before the court below, then the same shall be decided subject to legal impediment strictly in accordance with the law of the land.
