Neutral Citation No. - 2025:AHC:13085 Court No. - 6 Case :- WRIT - A No. - 19453 of 2024 Petitioner :- Km. Rupali Respondent :- State Of Up And 2 Others Counsel for Petitioner :- Aniruddh Tiwari,Varun Dev Sharma Counsel for Respondent :- C.S.C. Hon'ble Neeraj Tiwari,J. 1. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The case of petitioner is that father of petitioner died on 4.3.2003 upon which brother of petitioner was given appointment on 22.5.2005. Thereafter, he solemnized marriage on 3.12.2017 and unfortunately died on 6.8.2024. Now petitioner is claiming appointment on compassionate ground upon the death of her father. 3. As per settled provision of service law, once the brother of petitioner was given appointment on compassionate ground in the year 2005, petitioner is having no right on compassionate appointment against her father rather in the present case after death of her brother, family of her brother can only claim the compassionate appointment. 4. Therefore, under such facts and circumstances, writ petition lacks merit and is, accordingly, dismissed. No order as to costs.
