5. This matter is being taken up in the National Lok Adalat held on 13.09.2025.
6. In the instant C-528 application, a Compounding Application (IA No. 01 of 2025) has been moved, which is supported with the affidavits of the applicant and respondent No. 2.
7. In the instant C-528 application, the applicant has challenged the
judgment and
order dated 11.03.2025, passed by learned Judicial Magistrate/ Civil Judge (J.D.), Pithoragarh in T-Criminal Case No.220 of 2024 (New Criminal Case No.14 of 2025), under Section 420 and 120-B IPC, 1860, registered at P.S. Kotwali Pithoragarh and to dispose of the Criminal Appeal No.42 of 2025, pending before the learned Additional Sessions Judge, Pithoragarh.
8. Learned counsels for the parties submit that the parties have settled their disputes amicably and there is no pending dispute between them.
9. Since, now the applicant and respondent no.2 have amicably settled their disputes, therefore, there is no useful purpose to continue the proceeding of Criminal Appeal No.42 of 2025, pending before the
learned Additional Sessions Judge, Pithoragarh.
10. After taking into consideration the arguments, as advanced by learned counsel for the parties, and further taking into consideration the fact that the applicant and respondent no.2 have amicably settled their disputes, the present compounding application deserves to be allowed.
11. Accordingly, the compounding application is allowed. The judgment and order dated 11.03.2025, passed by learned Judicial Magistrate/ Civil Judge (J.D.), Pithoragarh in T-Criminal Case No.220 of 2024 (New Criminal Case No.14 of 2025), under Section 420 and 120-B IPC, 1860, registered at P.S. Kotwali Pithoragarh, is set-aside and further proceedings of Criminal Case No.220 of 2024, for the offences punishable under Sections 420 and 120-B IPC, registered at P.S. Kotwali Pithoragarh is quashed and the Criminal Appeal No.42 of 2025, pending before the learned Additional Sessions Judge, Pithoragarh is
disposed of qua the applicant.
12. In view of this, the present C528 application is
disposed of.
13. Pending application, if any, also stands disposed of.
