( 2025:JHHC:13240 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 3324 of 2025 ------ Abdul Rajjak @ Rajak Ansari @ Md. Razzaz Ansari @ Abddul Razzak, aged about 20 years, S/o Md. Jalaluddin Ansari, resident of village –Dumariya, P.O.+P.S. –Sonaraithari, District –Deoghar. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Arvind Kr. Choudhary, Advocate For the State : Mr. Shailendra Kr. Tiwari, Spl. P.P. ------ Order No.02 Dated- 01.05.2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Cyber Crime P.S. Case No.13 of 2025 registered for the offences punishable under sections 319(2), 318(4), 338, 336(3), 340(2) & 61 of the B.N.S., 2023 read with Section 66 B/66 C/66D and 84C of the Information Technology Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in commission of cybercrime and cheating Rs.10/- from Surendra Mewada. It is further submitted that the allegations against the petitioner are all false and the petitioner has no criminal antecedent as has been mentioned in para-12 of the bail application. It is then submitted that only because one mobile phone and two sim cards have been recovered from the petitioner, he has been implicated in this case. It is next submitted that the petitioner has been in custody since 28.01.2025, as has been mentioned in paragraph no. 11 of the bail application. It is then submitted that the petitioner undertakes to transfer Rs.10/- to the account of Surendra Mewada without prejudice to his defence in this case. It is further submitted that the petitioner undertakes to cooperate with the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Spl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on showing the proof of transferring Rs.10/- to the bank account of Surendra Mewada and on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Cyber Crime Case, Deoghar, in connection with Cyber Crime P.S. Case No.13 of 2025 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case.
