In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The present petition has been filed inter-alia with the following prayer:- "(a) Issue an order or direction, to the respondent no.2 i.e. Tehsildar, Tehsil Haraiya, District Basti, to expedite the Case No.RST/00039/2015 (Computer Case No.T201517140100039) (Sudama Vs. Dukkhi), under Section 34/35 of U.P. Land Revenue Act, 1901, expeditiously within a time bound period as fixed by this Hon'ble Court." 4. The matter is pending before the Court below since 2015 and considerable time has already been lapsed but till date no final decision has been taken in the matter. 5. In the facts and circumstances of the case, the present petition is disposed of directing the respondent no.2 i.e. Tehsildar, Tehsil Haraiya, District Basti to decide the Restoration Application filed in the aforesaid case strictly in accordance with law most expeditiously and preferably within a period of two months from today but without granting unnecessary adjournment unless there is no legal impediment. 6. Registrar (Compliance) is directed to communicate a copy of this order to respondent No.2/Tehsildar, Tehsil Haraiya, District Basti through District Magistrate, Basti within a week.
