ORDER (ORAL)
1. Pursuant to our order dated November 12, 2025, Mr. Anil Kumar Singh [Finance Commissioner (Addl. Chief Secretary) PW(R&B) Department, Civil Secretariat, Jammu] has joined the proceedings online. And submits that a detailed compliance report on behalf of respondent Nos. 2 to 4 has since been filed. With reference to the averments set out in paragraph 11 (Page 11 of the compliance report), he submits that a substantial amount of funds i.e. Rs. 595.24 lacs (Rupees Five Crore Ninety Five Lacs and Twenty Four Thousand only) stands released by the higher authorities on account of compensation. Which has been placed at the disposal of the Executive Engineer PWD (R&B), Division Chenani for further deposit to the Collector Land Acquisition (SDM), Dudu. As regards the balance amount of Rs. 1,26,48,607 (Rupees One Crore Twenty Six Lacs Forty Eight Thousand Six Hundred and Seven only) is concerned, he Sr.No. 21

submits that post passing of the award, the said amount too shall be deposited with the Collector Land Acquisition:-
“It is submitted that in respectful compliance to the directions issued by the Hon’ble High Court issued vide its order dated 12-11-2025, substantial amount of funds to the tune of Rs. 595. 24 lacs (Rupees Five crore ninety five lacs and twenty four thousand only) stands released by the higher authorities vide Order No. 16/Capex/Transfer/BCAPWD8/CtrlOfficeBca- BE/2025-2026/11/394 dated 14-11-2025 on account of compensation of land having been acquired in respect of construction of Mantalai to Dudu Basantgarh Road being the subject matter of both the above referred cases and the same has been further placed at the disposal of the Executive Engineer PWD (R&B) Division Chenani vide
order No.
16/JKUT/BCAPWD17/UTHOD-BE/2025-2026/11/585 dated 14-11-2025 for further deposit to the Collector Land Acquisition (SDM), Dudu being the part of both the above referred cases. Copy of the order No. 16/Capex/Transfer/BCAPWD8/CtrlOfficeBca-BE/2025-2026/11/394 dated 14-11-2025 and 16/JKUT/BCAPWD17/UTHOD-BE/2025- 2026/11/585 dated 14-11-2025 is enclosed and the same is marked as Annexure-I Collectively.
It is respectfully submitted that so far as the balance amount of Rs. 1,26,48,607/- is concerned, the answering respondents respectfully submit that immediately after the award is passed, the balance amount shall be deposited with the Collector Land Acquisition (SDM), Dudu.”
2. In the wake of the above, learned counsel for the petitioners submits that, for the present, nothing substantive survives in the petition, the same be
disposed of as infructuous. However, in the event any fresh cause of action arises, the petitioners be granted liberty to re-approach this Court.
