Heard learned counsel for the petitioners and learned A.G.A. for the State-respondents. 2. This writ petition has been filed for quashing the First Information Report dated 06.11.2024 giving rise to Case Crime No. 0244 of 2024, under Sections 115(2), 352, 351(3) and 331(6) of Bharatiya Nyaya Sanhita, 2023, Police Station - Muskara, District Hamirpur. 3. Contention of the learned counsel for the petitioners is that the matter was referred to the Allahabad High Court Mediation & Conciliation Centre and a settlement had been arrived at between the parties and it has been recorded that the first information report was got lodged under some misunderstanding. The paragraph no. 7 of the settlement arrived at 23.03.2025 is being reproduced here as under : “7. वादकारियों के बीच में निम्लिलित समझौता सम्पन्न हुआ हैः- क. यह निक आशीष कु मा, अजय ाजपूत (याचिचकाकता' सं. 1 औ 2) एवं आन्द गुरुदेव (प्रचितवादी स.4) द्वाा सहमचित हुई है निक कु छ गतफहमी औ भ्रम के काण वत'मा प्राथनिमकी दज' की गई थी, अब मामा पक्षों के बीच सौहाद'पूण' ढंग से सुझ गया है औ वे आगे मुकदमा हीं का चाहते हैं . यह निक दोो पक्षों के बीच इस बात प भी सहमती बी है निक अब उके बीच कोई निववाद शेष ही बचा है। ग. यह निक दोो पक्ष एक दूसे के निवरूद्ध पंजीकृ त /निवचााधी समस्त (सिसनिव/निFनिम) वादो को वापस/समाप्त का ेंगे एवं निकसी भी पक्ष को कोई भी आपलिH ही हैं। घ. यह निक दोो पक्ष एक दूसे के लिाफ, इस वाद के संन्दभ' में कोई या वाद दाय ही केंगे।” 4. We are of the view that the First Information Report dated 06.11.2024 registered as Case Crime No. 0244 of 2024, under Sections 115(2), 352, 351(3) and 331(6) of Bharatiya Nyaya Sanhita, 2023, be quashed.
