Against the order dated 11.10.2023 passed by the respondent no.2-Deputy Collector/Additional Deputy Collector, Tehsil Robertsganj, District Sonbhadra in Case No. 3758 of 2021 (Kamlesh Versus State of U.P.), present restoration application has been filed by the petitioner on 06.07.2024, but till date no decision has been taken, hence the present writ petition. 2. In view of the order proposed to be passed herein, no useful purpose would be served by putting the respondent(s) to notice and keeping this petition pending before this Court. However, in case the respondent(s) feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. Heard learned counsel for the petitioner, learned Standing Counsel appearing on behalf of the State-respondents and perused the record. 4. In view of the aforesaid, present writ petition is disposed of directing the respondent no.2-Deputy Collector/Additional Deputy Collector, Tehsil Robertsganj, District Sonbhadra first of all to decide the delay condonation application within three weeks from the date of production of a certified copy of this order and thereafter restoration application, unless there is no legal impediment.
