Hon'ble J.J. Munir,J. (Order on Civil Misc. Exemption Application No. Nil of 2025) 1. This application has been moved in Court today by Mr. Arvind Kumar Maurya, learned Counsel appearing on behalf of Mr. Govind Prasad Srivastava alias Pandey Govind Prasad Srivastava and Mr. Ashok Pratap Singh, Advocates in the Revenue Court, Ballia. It is taken on record. Let it be numbered by the office. 2. This Court, by our order dated 17.01.2025 never intended to summon the applicants Mr. Govind Prasad Srivastava alias Pandey Govind Prasad Srivastava and Mr. Ashok Pratap Singh. There was a miscommunication and misunderstanding, where the conduct of the client instructing Mr. Mainuddin, Advocate was taken for the learned Counsel's lapse and it is for this reason that in our order dated 17.01.2025, we have referred to Mr. Mainuddin, Advocate. There is no Mr. Mainuddin, Advocate, who appears in this case before the Courts below. 3. In the circumstances, the order dated 17.01.2025 is clarified to provide that the applicants were never summoned and they need not appear in this matter. 4. This application is disposed of in terms of the orders aforesaid. (Order on the memo of Writ Petition) 1. A vakalatnama has been filed on behalf of respondent No. 4 by Mr. Suresh Chandra Verma and Mr. Manish Kumar, Advocates. It is taken on record. Let it be numbered by the office. 2. One of the prayers sought in this petition is that restoration application bearing Case No. 295/330/448, Jafar v. Zaheer, be decided. 3. Learned Counsel for the petitioner has produced a photostat copy of the order dated 22.01.2025 passed by the Consolidation Officer, Sadar, Ballia. A perusal of the order shows that the said case has now been decided. 4. The other prayer is for quashing the order dated 30.09.2024 passed by the Settlement Officer of Consolidation, Ballia in Transfer Application No. 64. This was a stay order passed in the pending transfer application. The said transfer application too, according to the petitioner, has been dismissed. 5. In view of above, no cause of action survives in this petition. 6. Accordingly, this writ petition is dismissed as infructuous. Order Date :- January 23, 2025 I. Batabyal (J.J. Munir, J.)
