Neutral Citation No. - 2025:AHC:11314 Court No. - 33 Case :- WRIT - C No. - 2091 of 2025 Petitioner :- Rajveer Singh & Another Respondent :- State Of U.P. & 6 Others Counsel for Petitioner :- Aqueel Ahmad,Kripa Shankar Tiwari,Vaibhav Tyagi,Vinit Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Vikram D. Chauhan,J. Heard learned counsel for the petitioners and learned Standing Counsel for the State. By means of the present writ petition petitioners seek the following relief:-
"a. Issue a writ, order or direction in the nature of certiorari calling for the records and the impugned order dated 13.07.2000 (as annexure no.1) & dated 29.09.2012 (as annexure no. 2) passed by Tehsildar, Tehsil Koil, Aligarh, the impugned order dated 27.12.2021 (as annexure no. 3) passed by Sub Divisional Magistrate, Tehsil Koil, Aligarh & the impugned order dated 23.09.2024 (as annexure no. 5) passed by Deputy Commissioner (Administration), Division Aligarh, Aligarh under the Uttar Pradesh Land Revenue Act, 1901, against the petitioners." It is submitted by learned counsel for the petitioners that petitioners have objected to the mutation of the private respondent and submits that the appeal and revision have already been rejected. On a pointed query being made to learned counsel for the petitioners as to how the writ petition would be maintainable against the mutation proceedings which are summary in nature,
learned counsel for the petitioners submits that he may be permitted to withdraw the writ petition with liberty to institute a civil suit for declaration of his rights. Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioners to approach the court of competent civil jurisdiction. It goes without saying that the mutation proceedings are summary in nature and would abide by any declaration by the court of competent jurisdiction.
