BAIL APP 191/2025 KULDEEP SINGH …Petitioner/Appellant(s) Through: Ms. Vasudha Sharma, Advocate Vs.
UT OF J AND K TH S.H.O. POLICE STATION SAMBA ...Respondent(s) Through: None
CORAM: HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE
ORDER 16.12.2025
1. Nemo for respondent.
2. After arguing for a while and when confronted with the nature of allegation leveled, ld. counsel for the petitioner apprised this Court that the matter is at fag end whereas the IO has already been examined and now the only witness who has prepared the charge- sheet is to be examined.
3. Since the matter has reached to the final culmination and from the time when the bail application was declined by the Trial Court since then some more witnesses have been examined, and the trial has reached to the final conclusion. In that background, without commenting upon the merits of the case and having regard to the fact that the petitioner is in custody for over nine years and with the
examination of almost all witnesses, there appears to be change in the circumstances enabling the petitioner to approach afresh before the Trial Court for considering his plea for grant of bail.
4. It is expected that as and when such application is filed, the Trial Court shall make its endeavour to dispose of the application at the earliest keeping in view the prolonged incarceration of the accused during the currency of the trial.
5. Petition is disposed of by granting liberty to the petitioner to lay a fresh motion for grant of bail.
6.
Disposed of as such.
