1. CPAN 79 of 2025 is filed alleging violation of the
order dated 24th July, 2025 passed by this Court on the writ petition. It is submitted by the learned advocate representing the applicant that affidavit in opposition to the writ petition is yet to be filed by the respondents which amounts to violation of the
order dated 24th July, 2025.
2. Vide order dated 24th July, 2025, Court granted liberty to the respondents to file affidavit in opposition to the writ petition within certain time; if affidavit in opposition is not filed within that time said act does not amount to willful, deliberate and
2 contumacious violation of the order dated 24th July, 2025.
3. Learned advocates representing Siliguri Municipal Corporation and respondent nos. 3 and 4 have jointly prayed for extension of time to file affidavit in opposition.
4. Hence, contempt application stands dismissed.
5. Time to file affidavit in opposition to this writ petition stands extended by 2 (two) weeks. Extension of time to file affidavit in opposition is peremptory. If respondents file affidavits in opposition petitioner shall also be at liberty to file affidavit in reply by 2 (two) weeks thereafter.
6. Parties shall be at liberty to mention the matter before the next available Circuit for inclusion under the heading ‘Hearing’ after the time fixed hereinabove for exchanging affidavits.
