Present writ petition has been filed by the petitioner intr-alia with the prayer to direct the respondent no.3-Sub Divisional Magistrate, Tehsil Kasya, District Kushinagar to decide the recall application dated 29.08.2022 of the petitioner filed in Case No. 337 of 1985 (Dinesh Versus Kedarnath) under Section 229-B of U.P.Z.A. and L.R. Act regarding the revenue village Bairiyaraja, Tappa Mainpur, Pargana Sidhuwa Jobna, Tehsil Kasya , District Kushinargar, expeditiously. 2. In view of the order proposed to be passed herein, no useful purpose would be served by putting the respondent(s) to notice and keeping this petition pending before this Court. However, in case the respondent(s) feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. Heard learned counsel for the petitioner, learned Standing Counsel appearing on behalf of the State-respondents and perused the record. 4. In view of the aforesaid, present writ petition is disposed of directing the respondent no.3-Sub Divisional Magistrate, Tehsil Kasya, District Kushinagar to decide the aforesaid recall application in accordance with law, expeditiously preferably within a period of three months from the date of production of a certified copy of this order, without granting any unnecessary adjournment to either of the parties, if there is no legal impediment.
