By means of the present criminal writ petition, petitioner has challenged the FIR No.345 of 2021 dated 02.10.2021, for the offences punishable under Sections 3, 5, 11(1) of the Uttarakhand Protection of Cow Progeny Act, 2007, registered with P.S. Banbhulpura, District Nainital. 4. It is informed by the learned State Counsel that after investigation, charge-sheet has been submitted by the Police against the petitioner, therefore, nothing remains to be decided in this writ petition and it has become infructuous. 5. This fact is not disputed by learned counsel for the petitioner. 6. In view of the statement made by learned State Counsel, the present criminal writ petition is dismissed as infructuous. However, it is open to petitioner to challenge the charge-sheet in appropriate proceedings, before the appropriate forum. 7. Interim order dated 15.11.2021 stands vacated.
