Learned Senior Advocate submits that the applicant was enlarged on bail for committing alleged offence under Section 419, 420, 467, 468, 471, 406, 506 I.P.C vide Criminal Misc. Bail Application No.55874 of 2021 vide order dated 09.03.2022. Subsequently he has been implicated under Section 409 I.P.C wherein he isseeking Anticipatory Bail. He was enlarged on interim anticipatory bail by this court on 11.12.2024. He has submitted that the implication under Section 409 I.P.C has been made only to put the applicant behind the bars even after the bail was granted under the earlier sections of implication. Learned AGA has pointed out that applicant has criminal history of four cases. Learned Senior Advocate has rejoined and submitted that two cases are same being Case Crime No.28 of 2021 and 41 of 2021, which have been discussed in the order. Implication under Gangsters Act was made due involvement in these cases. Case Crime No.698 of 2020 is regarding business transaction between the parties and is of civil nature. Interim anticipatory bail application granted to the applicant is confirmed. He shall remain on anticipatory bail till conclusion of trial on the same terms and conditions as given in the interim anticipatory bail order dated 11.12.2024.
