ORDER
Learned counsel for the plaintiffs has made the following endorsement in the plaint today:
" The 2nd plaintiff and the 5th plaintiff passed away leaving behind their sons, plaintiff Nos.3 and 4 as the legal heirs. Subsequently, the 4th plaintiff died issueless without any Class I legal heirs. The 3rd plaintiff is Class II legal heir of the 4th plaintiff. On 22.07.2024, the 3rd plaintiff also passed away leaving 1/4 https://www.mhc.tn.gov.in/judis
behind his wife and children as his legal heirs. They are the proposed parties in A.No.33 of 2025. The demise of plaintiff Nos.2, 3, 4 and 5 may be recorded and thus render justice."
2. The legal representatives of the third plaintiff have filed application Nos.31, 32 and 33 of 2025. The said applications have been filed for the following reliefs: a) To condone the delay of 144 days in setting aside the abatement caused due to the death of the third plaintiff on 22.07.2024; b) To set aside the abatement caused due to the death of the third plaintiff on 22.07.2024; c) To bring on record the applicants Nos.6 to 8 as the legal representatives of the deceased third plaintiff (S. Anthony).
3. The learned counsel for the defendant has not raised any serious objection for allowing these applications. This Court is satisfied with the reasons stated in the affidavit filed in support of these applications as sufficient cause has been shown. Accordingly, A.Nos.31, 32 and 33 of 2025 2/4 https://www.mhc.tn.gov.in/judis
are allowed as prayed for and the legal representatives of the third plaintiff are brought on record as plaintiffs in the suit. Similarly, the demise of the plaintiffs Nos.2, 4 and 5 are also recorded as per the endorsement made by the learned counsel for the plaintiff. It is now recorded by this Court that all the legal representatives of the respective deceased plaintiffs are now brought on record as seen from the endorsement made by the learned counsel for the plaintiffs today.
4. The learned counsel for the plaintiffs is directed to carryout the amendment in terms of this order.
