Contd..2P.. THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2793 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The petitioner was arraigned as Accused in Crime No.15 of 2025 of Tanakal Police Station, registered for the alleged offences under Sections 299, 196(1) of the Bharatiya Nyaya Sanhita 2023. 3. The learned counsel for the petitioner submits that there are no specific allegations against the petitioner and he was falsely implicated in the complaint. It is alleged in the complaint that the petitioner promoted enmity between Hindu and Muslim religions by way of posting hateful content on social media platforms, i.e., Facebook. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Tanakal Police Station, Sri Sathya Sai District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation in connection with Crime No.15 of 2025. -2- CRL.P.
