Hemchandra is present before the Court physically. Learned counsel for respondent No. 1, Mr. L. Raju; learned senior counsel for respondent No. 2, Mr. N. Ibotombi; and learned senior counsel for respondent No. 3, Mr. T. Momo are also present before the Court physically. This contempt petition has been initiated by the complainant/petitioner under section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India whereby in this proceeding seeking intervention for willful and deliberate disobedience of the order dated 20.07.2022 rendered by the learned Single Judge on the writ side in W.P. (C) No. 724 of 2019 with W.P. (C) No. 916 of 2019 vide Annexure-A/6 and the judgment and order dated 26.07.2024 rendered by the Division Bench at Gauhati High Court in W.A. No. 27 of 2023 and W.A. (C) No. 916 of 2019] vide Annexure-A/7. This is the status which is indicating in this contempt proceeding as initiated by the complainant/petitioner for seeking implementation of the order, even in terms of disobedience of the order rendered by the learned Single Judge on the writ side which was confirmed by the Division Bench of the Gauhati High Court in the writ appeal proceeding as was initiated before the Gauhati High Court. This is the position which is indicating in this contempt proceeding as being initiated by the complainant/petitioner. This status has been recorded in the presence of learned counsel for the respondents. In a given peculiar facts and circumstances in this matter are concerned, the learned senior counsel for the complainant/petitioner is seeking permission to withdraw this contempt petition with liberty for initiation of the contempt proceeding relating to the aforesaid order rendered by the learned Single Judge on the writ side, before the learned Single Judge. Therefore, keeping in view the submission made by the aforesaid learned senior counsel for the complainant/petitioner in this matter, it is deemed appropriate that the complainant/petitioner be permitted to persuade the matter in accordance with law and also to initiate contempt proceeding before the learned Single Judge, relating to the order rendered by the learned Single Judge on the writ side. Page | 3 Accordingly, made an observation and the complainant/petitioner is permitted to withdraw this contempt petition. However, learned senior counsel for the complainant/petitioner in this matter be directed to submit a memo in writing to that effect. Consequently, this contempt proceeding is hereby closed permitting the complainant/petitioner to persuade the matter in accordance with law. JUDGE CHIEF JUSTICE Sandeep
