Petitioner was appointed as Lecturer in a Government Aided Institution, namely, Chaudhary Bharat Singh, D.A.V. Inter College, Jahbrera, District Haridwar w.e.f. 21.12.2005. The post of Principal fell vacant in the said college on 01.04.2014. Petitioner was handed over charge of Officiating Principal, however, the benefits of downgrade Principal are not given to him, thus, feeling aggrieved, petitioner has filed this writ petition, seeking the following relief:- (i) Issue a writ, order or direction in the nature of mandamus, commanding/directing the respondents to give promotion to the petitioner on the post of “Downgrade Principal” in Chaudhary Bharat Singh, D.A.V. Inter College, Jahbrera, District Haridwar in view of government order dated 28.10.2020 (Annexure No. 5) and the scheme provided in Uttarakhand School Education Board (First Amendment) Regulation, 2011. 4. Learned State Counsel submits that petitioner has sought a writ of mandamus without making a representation to the Competent Authority. He submits that if petitioner has any grievance, then he could have approached the Competent Authority. 2025:UHC:5848-DB 5. We, therefore, dispose of the writ petition with liberty to petitioner to make representation to the Competent Authority for claiming benefit of downgrade Principal. If petitioner makes representation within two weeks from today, the Competent Authority shall examine petitioner’s claim, in the light of Regulations governing the field, and pass order, within four months from the date of receipt of such representation along with certified copy of this order.
