PUBLIC PROSECUTOR The Court made the following: ORDER:- This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/A2, seeking regular bail, in Crime No.04 of 2025 of Nidadavole Town Police Station, East Godavari District. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 8(c) r/w / flrI `
2 20(b)(ii)(C) of the Narr6otic Drugs and psychotropic substances Act,1985 (for short lthe NDPS Act'). 3. The brief facts of the case are that on 10.01.2025 on receipt of information about the presence of accused in Nidadavole with ganja, the sl of police along with staff, rushed to open space nearby vacant TIDCO houses, Theerugudem Village h/o Nidadavole and arrested Al to All and seized in possession Of total ganja 21.965 kgs from Al to All. 4. Heard. Perused the record. 5.
Learned counsel for the petitioner submits that, according to the case of the prosecution's case, a total of 21.965 kgs of ganja was seized from the accused, which does not constitute a commercial quantity. Upon apprecI-ating the rl'val contentions and reviewing the remand report, it appears that the investigating officer from Nidadavole Police Station has seized 22 kgs of ganja from Al to All. Based on the allegations at this stage, it cannot be determined whether the seizure made from each indl'vidual is to be consl-dered as an individual sel'zure or a coIIectl-ve seizure. The learned counsel for the petitioner further submits that the petitioner has a permanent residence, and there is no possibility of his fleeing from the jurisdiction of the court. <
3 The learned Assistant Public Prosecutor relies on the confess'lon statement, which is said to indicate that the ganja was collected from A12, who is a resident of Orissa. 6. As per the record, the petitioner/A2 has been in judicial custody since 10.01.2025, and the petitioner is aged 22 years. Moreover, the contraband said to have been Seized from the petitioner does not constitute a commercial quantity. When ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no previous antecedents under the NDPS Act. Most of the witnesses are shown to be offilcial witnesses and the release of the petitioner/A2 would not cause hampering of investigation, this Court is inclined to grant bail to the petitioner herein/A2, on the following conditions: (i) The petitioner/A2 shall be released on executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the learned Special Judge for Trial of Offences Under NDPS Act- cum-I Additional District and Sessions Judge, Eluru, West Godavari District. (ii) After release, the petitioner shall appear before the Station House Officer concerned, once in a fortnight for a period of three (03) months.
