The instant application under Section 482 Cr.P.C. has been filed seeking a direction to the learned court below to decide the Case No. 618 of 2018 (Priyanka Devi vs. Shashi Kant Sharma) under Section 125 Cr.P.C., P.S. Narhin, District Ballia, pending in the Court of Principal Judge, Family Court, Ballia expeditiously. 3. Looking at the nature of prayer, learned AGA raised a preliminary objection that the application under Section 482 Cr.P.C. is not maintainable as specific remedy is provided under Section 483 Cr.P.C. and the instant application has been wrongly filed under Section 482 Cr.P.C. 4.On such objection, learned counsel for the applicant seeks to withdraw the instant application with liberty to file appropriate application. 5. Accordingly, the instant application is dismissed as withdrawn. 6. Certified copy of the documents shall be returned to learned counsel for the applicant by retaining the photocopy thereof.
