Omshree Respondent :- State Of Up And 8 Others Counsel for Petitioner :- Abhishek Mishra,Harendra Yadav,Prabhat Singh Counsel for Respondent :- C.S.C.,Suresh Singh,Vimlesh Kumar Rai Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner claims to be the second wife of deceased Ramdas Savita, who was employed in U.P. Jal Nigam (Urban) since died. She has approached the District Magistrate for issuance of a succession certificate/family certificate to her. The claim of the petitioner is opposed by learned counsel for respondent nos.6 to 9, who claim to be the sons and daughters of deceased employee Ramdas Savita. It is also submitted that in fact the petitioner has never solemnized marriage with the deceased employee. The copy of the succession certificate issued by the competent civil court in favour of the private respondents has also been placed on record. Once that be so, remedy of the petitioner would be before the competent civil court. Copy of the succession certificate has also been handed over to learned counsel for the petitioner today in Court. Leaving it open for the petitioner to pursue remedy before the competent civil court, this petition is consigned to records.
