Applicant-Khushboo Yadav has filed this petition under Section 407 Code of Criminal Procedure for transfer of Case No. 417 of 2024; titled State vs. Rahul Yadav, arising out of Case Crime No. 94 of 2023, under Sections 323, 504, 506, 494 IPC, registered at Police Station Gyanpur, District Bhadohi pending before Additional Chief Judicial Magistrate, Bhadohi (Gyanpur) to any other court of competent jurisdiction at District Prayagraj/Allahabad. When the case is called out, no one has appeared on behalf of the applicant. Applicant-complainant seeks transfer of the Case No. 417 of 2024 from Bhadohi to Prayagraj on the ground that another case filed by her under Section 9 Hindu Marriage Act is pending adjudication at Prayagraj. Since, both the cases were filed by the applicant-complainant herself, therefore, this Court is not inclined to transfer of the subject case, as the distance between the two towns is approximately 60 kms. Resultantly, the application fails and is hereby dismissed.
