Counsel for Applicant :- Alok Singh,Chandra Prakash,Shashank Shekhar Counsel for Opposite Party :- G.A. Hon'ble Deepak Verma,J.
1. Supplementary affidavit filed today, is taken on record.
2. Heard learned counsel for the applicant and learned A.G.A. for the State.
3. The instant Anticipatory Bail Application has been filed with a prayer to grant an anticipatory bail to the applicant in Case Crime No. 19 of 2024, under Sections 420, 465 IPC, Police Station- Kheragarh, District- Agra.
4. Learned counsel for the applicant submitted that applicant is innocent and has been falsely implicated in the present case due to ulterior motive. Prima facie, no offence under alleged sections is made out against the applicant. Investigating Officer has submitted charge-sheet in the matter. Lastly, it is submitted that the applicant is apprehensive of imminent arrest. In case, the applicant is released on bail, he would not misuse the liberty of bail and would cooperate with the investigation.
5. Per contra, learned AGA vehemently opposed the prayer for anticipatory bail of the applicant with the contention that the applicant is not entitled for anticipatory bail as, prima facie, case is made out. The apprehension of the applicant is not founded on any material on record, only on the basis of imaginary fear, the anticipatory bail cannot be granted.
6. Considered the submissions advanced by learned counsel for the applicant and perused the entire record. On perusal of record, it is apparent that charge-sheet has been submitted and Trial Court has issued summons against the applicant. Prima facie, offence is made out against the applicant. There is no apprehension of arrest
of the applicant by the police. No interference is warranted.
7. Accordingly, the present anticipatory bail application stands rejected. Order Date :- 11.2.2025 Aditya Digitally signed by :- ADITYA KUSHWAHA High Court of Judicature at Allahabad
