JUSTICE SAMEER JAIN Order 12/02/2025 Learned counsel for the petitioner has submitted that the similar controversy as that in the instant matter is already adjudicated by the Division Bench of this Court in State of Rajasthan and Ors. vs. Ramniwas Porwal reported in 2008 (2) RLW 1270 (Raj.). While placing reliance upon the above cited it is submitted that the instant matter can be decided in light of the above cited and ratio passed therein can be made applicable qua the petitioner herein. Learned counsel for the respondents has not refuted the contentions made by the learned counsel for the petitioner. Accordingly, the present petition is allowed in light of Rajasthan and Ors (Supra), and ratio passed therein be made (2 of 2) [CW-5459/2002] squarely applicable qua the petitioner herein.
