Heard Sri Girish Kumar Gupta, learned counsel for petitioner and Mrs. Shruti Malviya, learned Standing Counsel for State- Respondents. 2. Petitioner before this Court is admittedly a fence-seater. He was retired in 2021 and is now claiming benefit as granted to other employees with regard to consideration of his service rendered in Cement Corporation. 3. Learned counsel for petitioner refers judgments passed by this Court that similar benefit be granted to petitioner also. 4. Learned Standing Counsel submits that not only petitioner is a fence seater but has also not filed any representation during his service period or even after his retirement, except one, i.e., dated 26.02.2023. 5. I have considered the above submissions. Though petitioner is a fence seater, still considering that similarly situated persons are granted certain benefit, therefore, this writ petition is disposed of with observation that claim of petitioner be also considered, however, while considering his claim aspect of delay may also be taken note of.
