Order 07/08/2025
1. The instant writ petition filed by the petitioner has challenged the order dated 30.11.1997 whereby penalty of withholding one annual grade increment without cumulative effect has been imposed upon the petitioner. He has also assailed the
order dated 01.10.2001 whereby the review petition filed by the Revisional Authority has been dismissed.
2.
Learned counsel for the petitioner would submit that the Disciplinary Authority has imposed the penalty against the petitioner in quite mechanical manner and without analyzing the reply to the charge-sheet.
3. On the contrary, learned counsel for the respondents has submitted that the charges against the petitioner were serious
[2025:RJ-JP:30577] (2 of 2) [CW-5046/2004] in nature and even while tendering explanation to the charge- sheet, he has passed on unwarranted remarks against the then ADJ Ratangarh.
4. I have considered the record as well as the impugned penalty order as well as order passed in review petition.
5. After meticulously examining the seriousness of the charges and the kind of response which has been given by the petitioner, I find that no error or illegality has been committed by the Disciplinary Authority in imposing penalty of withholding one annual grade increment without cumulative effect, which is in fact a minor penalty under the Disciplinary Authority. The review petition has also properly been considered by the competent authority and after taking into consideration all the grounds in the review petition and by giving rational findings, the same has been dismissed vide order dated 28.09.2001/01.10.2001.
6. In the light of above, there is no ground to interfere in the petition, the same is hereby dismissed.
