The Writ Petition is filed questioning the action of the respondents in not releasing the pending due amounts of Rs.10,63,072/- payable to the writ petitioner even after finalization of the bills in relation to the work i.e. Laying CC Road and CC Drain from D.No.9/40 to 9/172, 9/171 to 9/57, 9/57 to 9/158 at Maratwadi Street in E.W.No.31 in Adoni Municipality under GGMP Funds vide Agreement No.283/2024-25, Dated 05.08.2024 vide M. Book No.229/2023-24, as illegal and arbitrary. 2. Heard Sri Komma Vijaya Rajkumar, learned counsel for the Petitioner and Sri Gudapati Lakshmni Narayana, learned Standing Counsel for the Respondent-Municipality. 3. At the time of hearing, the learned Standing Counsel for the Respondent-Municipality passed on written instructions received by him, signed by the Commissioner, Adoni Municipality, wherein it is revealed that the writ petitioner had completed the works executed by him, but due to lack of funds the amounts could not be paid to the writ petitioner and whenever the amounts released under GGMP Funds, the amounts due to the writ petitioner will be paid. 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of works and the amounts due to the writ petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides and by placing the written instructions on record, with the following direction: 3 (i) The Respondent authorities are directed to pay the amounts due to the writ petitioner within a period of four (04) months from the date of receipt of the copy of this order. There shall be no order as to costs. Consequently, miscellaneous applications, if any, pending shall stand closed. __________________ NYAPATHY VIJAY, J Date: 02.04.2025.
