The present application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to issue a direction to the Sub Divisional Magistrate, Tehsil- Gola, District- Gorakhpur to decide the Case No. 102 of 2023 (State Vs. Nirmala Devi and another) under Section 145 of Cr.P.C. within stipulated period. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
