OMP No.309 of 2025 in Arb. Case No.102 of 2022. Item No. (D-19)
11.04.2025 Present: Ms. Srishti Chauhan, Advocate, for the applicant. Mr. Lokender Thakur, CGC, for the respondents. OMP No.309 of 2025. Issue notice. Mr. Lokender Thakur, learned counsel appears and waives service of notice on behalf of respondents. This is the second application which has been filed seeking extension of time for concluding arbitration proceedings. In view of the provision under Section 29 A sub-clause 4 and 5 of the Act, it has been pointed out that on earlier occasion, extension has been sought by filing OMP No.858 of 2024, which was allowed on 27.09.2024 and the arbitration proceedings had been extended by six months, which would commence from 15.10.2024. It is thus submitted that the mandate would thus expire on 14.04.2025. It is pointed out that in the order dated 14.01.2025 (Annexure P-13) passed by the Arbitral Tribunal on account of addition as such of another party, the delay has occurred in the case which is at the stage of argument.
Similarly, it is submitted in the order dated 26.03.2025 passed by the said Tribunal that there was a consensus as such that the application is to be filed before this Court for extension and there would be no objection and the case is at the stage of the final arguments. Keeping in view the above facts, the application is allowed and the mandate of the Arbitral Tribunal is extended for three months. The application is disposed of in the aforesaid terms. (G.S.
