[2025:RJ-JP:30532] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 4135/2002 Lokesh Kumar Sharma S/o Shri R.C. Sharma, 854, Jamna Dairy, Sodala, Ajmer Road, Jaipur. ----Petitioner Versus 1. State Of Rajasthan through The Secretary, Technical Education, Government Of Rajasthan, Government, Jaipur. 2. Director, Technical Education, Government Of Rajasthan, Jodhpur. ----Respondents For Petitioner(s) : Mr. Virendra Lodha Sr. Adv. With Mr. Jai Lodha For Respondent(s) : Mr. Avanish Kumar Sharma, Dy.G.C. Mr. Ajay Verma HON'BLE MR. JUSTICE ANAND SHARMA Order 07/08/2025 1. In the instant writ petition, the petitioner has prayed for direction against the respondents to grant him salary for the period commencing from 14.03.1990 to 10.01.1991 as well as grant benefit of selection grade from 16.01.1989. 2. Reply to the writ petition has been filed, in which it has been mentioned that the petitioner has never worked with the respondents between the period from 14.03.1990 to 10.01.1991 hence, he cannot claim salary for the aforesaid period. Counsel for the petitioner has not disputed the aforesaid contention. 3. It is also contended in the reply that earlier service of the petitioner was terminated w.e.f. 14.03.1990. The petitioner, [2025:RJ-JP:30532] (2 of 2) [CW-4135/2002] aggrieved by his termination filed a writ petition before this Court bearing S.B. Civil Writ Petition No. 5010/1989 and in view of interim order passed by this Court, this service was allowed to continue. Thereafter, his services have been regularized w.e.f. 17.05.1995. 4. So far as relief of selection grade is concerned, in view of judgment of Hon’ble Supreme Court in the case of the State of Rajasthan & Ors. Vs. Jagdish Narain Chaturvedi 2009 (12) SCC 49, such benefit can be granted after completing length of service from the date of regular appointment. Thus, till the date of filing of the writ petition, he had not completed even 9 years on the date of regular appointment i.e. 17.05.1995. 5. Hence, in view of above, I do not find any ground to interfere in the instant writ petition and the same is hereby dismissed. (ANAND SHARMA),J NEERU/19
