The applicant - Arun Singh is in judicial custody for the offence under Section 305(e) and Section 317(2) of the Bharatiya Nyaya Sanhita, 2023 in Case Crime No.135 of 2025, registered at Police Station Dineshpur, District Udham Singh Nagar. 2. According to the First Information Report dated 14.07.2025, computer, CPU, UPS, Keyboard, Mouse, Printer, Router, Speaker and Mic were stolen on 04.07.2025 from the building of Government Primary School Madnapur, District Udham Singh Nagar. The FIR has been registered against unknown person. 3. On 15.07.2025, the applicant and three co- accused were arrested and at their behest stolen articles were recovered from a bag placed inside the 1 2025:UHC:7857 bathroom of a derelict factory. 4. Heard Ms. Manju Bahuguna, learned counsel for the applicant and Mr. Chitrarth Kandpal, learned Brief Holder for respondent. 5. Ms. Manju Bahuguna, Advocate, for the applicant has submitted that the applicant has been falsely implicated in the present matter. The said properties were not stolen by him. The alleged recoveries are false. Applicant has no criminal antecedents. He is in judicial custody since 15.07.2025. He is a permanent resident of District Udham Singh Nagar, therefore, there is no possibility of his absconding, and, Sameer Singh, the co-accused of similar role, has already been granted regular bail by this Court in First Bail Application No.1508 of 2025. 6. Mr. Chitrarth Kandpal, Brief Holder, has opposed the bail application orally. 7 7. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merits of the case, this Court is of the view that the applicant deserves bail at this stage. 8. The Bail Application is allowed. 9. Let the applicant – Arun Singh be released on 2 2025:UHC:7857 bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned. ___________________ ALOK KUMAR VERMA, J.
