JUSTICE SANDEEP KUMAR ORAL ORDER 5 18-12-2025 Heard the learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 188 of 2023 registered for the offence under Section(s) 366, 366A/34 of the Indian Penal Code, Section 3(i)(4), 3(i)(w)(i), 3(2)(va) and Section 8/12 of the POCSO Act. 3. As per the prosecution case, the petitioner is accused of taking away the minor daughter of the informant. 4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 21.05.2025. Patna High Court CR. MISC. No.65813 of 2025(5) dt.18-12-2025 2/2 5. Learned A.P.P. for the State has vehemently opposed the prayer for bail. 6. From the statement of the victim girl recorded under Section 183 BNSS it appears that the victim girl eloped with the petitioner and got married to him. 7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed. 8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-cum-Special Judge, POCSO Act, West Champaran/concerned Court below in connection with Gopalpur P.S.
