The present application has been filed with a prayer for setting aside the dismissal order dated 08.08.2024 in MFA No. 2 of 2019 by which the said appeal has been dismissed for non-prosecution. It has been submitted by Mr. K. Pradeep, learned counsel that by an order dated 22.08.2025 passed by the Hon’ble Chief Justice in MC (MFA) No. 1 of 2025 (Ref: MFA No. 2 of 2019), the application filed by the present applicant for condoning the delay in filing the restoration application was not only allowed but also the Hon’ble Court further passed an order restoring the proceeding of the connected MFA No. 2 of 2019 on record. The learned counsel accordingly submitted that the present application has become infructuous and the same can be closed. Mr. L. Brojen, learned counsel for the respondent endorsed the submission made by the learned counsel appearing for the applicant and submitted that the present application can also be closed.
