Heard learned counsel for the petitioner, learned Standing Counsel for the State respondent nos. 1 and 2 and Sri Devendra Tripathi, learned counsel for respondent no. 3. 2. Grievance of the writ petitioner is non-registration of his application purported to be moved under Section 67(1) of U.P. Revenue Code-2006 filed in the year 2021. 3. Learned counsel for the petitioner submits that after filing of the said application various reports have been received by the Sub Divisional Officer, however, neither the application has been registered nor the case is being decided. 4. Learned Standing Counsel points out that the title of the application is defective in view of the prayer made therein and also the reports indicate that the petitioner has been found entitled to benefit under Section 67-A of the Code. 5. Be that as it may, once the application has been entertained by the officer and reports have been called and also received, that too read in favour of the petitioner, there appears to be no reason not to conclude the proceedings pursuant to the application. 6. The writ petition is, accordingly, disposed of with the following directions:- (a) The Sub Divisional Officer, Machhalishahar, Jaunpur shall forthwith allot a computerized number to the application dated 28.07.2021 (Annexure No. 3 to the writ petition) as soon as the petitioner files a certified copy of this order along with photostat copy of the said application. (b) The Sub Divisional Officer shall, thereafter, decide the proceedings, after hearing the stand of State of U.P. and Gaon Sabha and based upon reports received by him, on or before 31.07.2025.
