The case is taken up today before the National Lok Adalat. This criminal revision is directed against the judgment and order dated 14.08.2025 passed by the learned Sessions Judge, Pithoragarh in Criminal AppealNo.92 of 2025 as well as judgment and order dated 29.05.2025 passed by the learned Judicial Magistrate, Pithoragarh in Criminal Case on. 269 of 2024 (new No.160 of 2024). Respondent no.2/complainant appeared before the National Lok Adalat through V.C., who is duly identified by his counsel. Revisionist, who is detained in District Jail, Almora, also appeared through V.C. It is submitted that parties have agreed to settle the matter. It is submitted by learned counsel for respondent no.2 that half of the amount has been paid by the revisionist to the respondent no.2 in cash and the remaining amount would be paid through cheque and the respondent no.2 does not want to prosecute the revisionist. The terms of the compromise have been recorded in a separate compromise sheet, which shall form part of the order. Accordingly, the Criminal Revision is allowed. The impugned judgment and order dated 14.08.2025 passed by the learned Sessions Judge, Pithoragarh in Criminal AppealNo.92 of 2025 as well as judgment and order dated 29.05.2025 passed by the learned Judicial Magistrate, Pithoragarh in Criminal Case on. 269 of 2024 (new No.160 of 2024) is set aside. Conviction and sentence awarded to the revisionist is also set aside. He is acquitted of the charge of offence punishable under Section 138 of the Negotiable Instruments Act. Revisionist is in jail. He shall be released forthwith without executing personal bond and without furnishing any surety. All pending applications stand disposed of. Let a copy of this be sent to the concerned jail forthwith.
