By means of this petition filed under Article 226 of the Constitution petitioner has submitted that the entire monetory loss for which the recovery has been directed from the pension has already stood deposited in the concerned heads and no dues certificate has also been issued in this regard by the District Social Welfare Officer, Prayagraj. 3. It is submitted that the petitioner had already applied before the Director Social Welfare, U.P, Lucknow to reconsider the matter in the light of the those fact which he has raised in his representation dated 27.08.2024. 4. Learned Standing Counsel submits that since the approval has been obtained in the matter from the Hon'ble Governor therefore, the Director may not be the competent authority. 5. In such above view of the matter, I dispose of this petition with direction to the Director Social Welfare U.P. Lucknow to look into and consider the representation of the petitioner dated 27.08.2024 and in the event he finds substance therein, he shall place the same before the concerned Secretary of the State Government to get approval granted by the Hon'ble Governor reviewed. The appropriate decision shall be taken by the Director concerned in the matter within one month of production of certified copy of this order.
