“10.1 That, Hon'ble court may kindly be pleased to direct the Respondent authorities to look into the complaint raised by the Petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to direct the Respondent authorities to take a just and proper decision on the representations made by the Petitioner. 10.3 Any other relief which the Hon'ble Court may deem fit, in the interest of justice.” 3
Brief facts of the case are that the petitioner was posted in Government Primary School Chindbhauna, Block Tamnar, District Raigarh, C.G on the post of Principal and performing her duties since 25.09.2023. The petitioner has repeatedly raised her grievance that one Monika Gupta who is posted as Block Education Officer Tamnar, District Raigarh, C.G, has been misusing her powers and she is responsible for deteriorated condition of the primary school and is misusing the Government aid for her own personal motives and further complaining that the schools are not functioning as per the norms and guidelines laid down by the Government of Chhattisgarh. 4 It is further case of the petitioner that she has made a representation before respondent No.1 alleging that Mahila Sw- Sahayata Samuh who have been given the contract for the preparation of the mid-day meal for Children, the preparation of the said meal is done by one Smt. Sacchi Gupta who is a teacher and entrusted with the work of teaching and she has been
3 preparing the meals as per her own whims and often involving the students for the preparation of the mid-day meal and when the petitioner tried to raise her voice against such malpractice done by the officers and teachers, she was threatened that she would be transferred. The said fact has been put up before the other authorities; such as the Chief Executing Officer of the Janpad Panchayat and the Sub-Divisional Officer, and the District Education Officer, but no action has been taken till date on her complaint. 5
Learned counsel for the petitioner submits that the inaction on the part of the respondent authorities is arbitrary and is opposed to public policy at large and is in violation of the guidelines laid down by the Government. He further submits that the aid sanctioned by the Government for the betterment of the children in school is being misused and the objections raised by the Petitioner ought to have been taken into consideration. It has been contended that the petitioner is being threatened by the local village panchayat and other officers that if she raises any objection she would be transferred. As such, he prayed that the respondent authorities be
directed to consider the case of the petitioner. 6 Considering the facts and circumstances of the case, the petitioner is directed to approach the concerned authority, in turn, the concerned authority is directed to consider the case of the petitioner in a pragmatic manner after giving due opportunity of
4 hearing to the petitioner as well as other party as according to the petitioner, she has been harassed because she has made a complaint against the Block Education Officer, Tamnar, District Raigarh. 7 It is made clear that this Court has not expressed any opinion on the merits of the case and if any adverse order is passed, the petitioner as well as other party will be at liberty to approach this Court, if occasion arises. 8 With the aforementioned observation/direction, writ petition stands
