Neutral Citation No. - 2025:AHC:27161-DB Court No. - 29 Case :- WRIT - C No. - 40249 of 2024 Petitioner :- Vinod Kumar Respondent :- Union Of India And 9 Others Counsel for Petitioner :- Vinod Kumar Counsel for Respondent :- A.S.G.I.,Atul Kumar Shahi,C.S.C.,Saumitra Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the petitioner, Sri Atul Kumar Shahi,
learned counsel for respondent no.8 and Sri Saumitra Singh,
learned counsel for the respondents. The petitioner before this Court is an Advocate. He is aggrieved by certain purchases made by Basic Siksha Adhikari, Pratapgarh. An objection is taken to the maintainability of the writ petition on the ground of territorial lack of jurisdiction as also on the ground that the petitioner has no locus to intervene. On a pointed query made by the Court, the petitioner in person admits that he is not an applicant for the contract. However, it is stated that in terms of the guidelines issued for regulating GeM portal, even a third person can make an objection. If that be so, we are concerned with the locus of the petitioner to file the present writ petition. Since none of the individual grievance of the petitioner is raised and the petition otherwise is not instituted in public interest, we find no locus in the petitioner to maintain this petition. The present writ petition is consequently dismissed.
