Neutral Citation No. - 2025:AHC:36622 Court No. - 3 Case :- WRIT - C No. - 39482 of 2024 Petitioner :- Ajit Kumar Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Aman Singh,Prateek Shukla Counsel for Respondent :- C.S.C. Hon'ble Jayant Banerji,J.
1. Heard learned counsel for the petitioner.
2. This petition has been filed seeking the following relief:
"(a) Issue a writ in the nature of mandamus directing the respondent No. 2 to decide the application dated 30.09.2024 of petitioner, wherein application dated 02.07.024 and 02.08.2024 is annexed, within specific time as fixed by this Hon'ble Court."
3. Despite Case No. 60 of 2022 (Ajit Kumar Vs. Bali Ram) filed under Section 49 of the U.P. Revenue Code, 2006 being finally decided by an order dated 12.10.2022, neither any appeal nor revision under the Revenue Code has been preferred by the petitioner. In the meanwhile, it seems that a recall application dated 14.11.2022 was filed by the petitioner before the respondent no. 3. When no action was taken by the respondent no.3, the petitioner filed a writ petition before this Court being Writ-A No. 2812 of 2024 (Ajit Kumar Singh Vs. State of U.P.), in which counter/rejoinder affidavits have been directed to be exchanged. Thereafter, the application dated 30.9.2024 has been moved by the petitioner before the Commissioner.
4. The petitioner is repeatedly making representations before the authorities, but not pursuing any statutory judicial remedy available to him under law. Repeated writ petitions are being filed by the petitioner. As stated above, another writ petition filed by the petitioner is pending before this Court, in which affidavits have been called for. However, there being no fresh cause of action, the instant writ petition has been filed by the petitioner.
5. The writ petition is, therefore, dismissed with cost of Rs. 500/- which shall be recovered from the petitioner, if not paid, within one month from today. Order Date :- 12.3.2025 sfa/ (Jayant Banerji, J) Digitally signed by :- SYED FAHEEM AHMAD High Court of Judicature at Allahabad
