By means of the present criminal writ petition, petitioner has challenged the order dated 28.09.2021 passed by learned Additional Chief Judicial Magistrate, Roorkee, District Haridwar, whereby, the learned Magistrate has dismissed the Miscellaneous Application No.173 of 2021 Mahant Jogendra Dass Vs. Mahant Raghu Muni Maharaj and Others, preferred under Section 156(3) of Cr.P.C. 4. It is agreeable to the learned counsel for the petitioner that the order impugned can be challenged by preferring a revision before the learned Sessions Judge and instead of doing this, petitioner straightway approached this Court for quashing the impugned order. 5. After arguing for a while, learned counsel for the petitioner wants to withdraw the present criminal writ petition with liberty to avail the remedy available to him under the revisional jurisdiction. 6. Accordingly, the present criminal writ petition is dismissed as withdrawn, with the aforesaid liberty. The time spent by the petitioner before this Court may be considered liberally by the learned Sessions Judge while entertaining the revision petition on the question of condonation of delay. 7. Pending applications stand disposed of.
