THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2780 of 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.1 in Crime No.32 of 2025 of Darsi Police Station, Prakasam District, registered for the alleged offences under Sections 329(4), 132, 308(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023. 3. The learned counsel submits that the petitioner’s wife was running a fair price shop. On 29.01.2025, the Revenue Divisional Officer, Darsi Mandal, Prakasam District, issued proceedings cancelling the authorization of the fair price shop operated by the petitioner’s wife. Challenging the same, the petitioner filed W.P. No. 3309 of 2025, and this Court allowed the writ petition, setting aside the impugned proceedings. Subsequently, on 08.03.2025, the Revenue Divisional Officer issued proceedings restoring the fair price shop of the petitioner’s wife. 4. It is alleged in the complaint that on 01.03.2025, the petitioner approached the Village Revenue Officer and threatened him. The alleged threat is on account of the P.D.S. fair price shop. The learned counsel submits that the P.D.S. fair price shop is operated by the petitioner’s wife and that there is no truth in the complaint lodged by the Village Revenue Officer against the petitioner. Furthermore, the Village -2- CRL.P. No.2780 OF 2025 Revenue Officer had no authority to interfere with the business in the fair price shop operated by the petitioner’s wife. 5. Considering the same, there shall be a direction to the Station House Officer, Darsi Police Station, Prakasam District, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation insofar as the petitioner is concerned, in connection with Crime No.32 of 2025. 6.
